The parties’ obligations under this Terms Of Service Agreement are subject to, and neither party shall be liable for, delays, failures to perform, damages, losses or destruction, or malfunction of any equipment or any consequence thereof caused or occasioned by, or due to fire, flood, water, the elements, labor disputes or shortages, utility curtailments, power failures, explosions, civil disturbances, governmental actions, shortages of equipment for supplies, unavailability of transportation, acts or omissions of third parties, or any other cause beyond the party’s reasonable control.

In no event shall WebHostJunction.com be liable to user or any of user's customers or any other person, firm or entity in any other respect, for direct, indirect, consequential, special, incidental, actual or punitive damages, or for any lost profits of any kind or nature whatsoever, even if foreseeable, arising out of any mistake, accident, error, omission, interruption, or defect in transmission, or delay arising out of or relating to the services or the obligations of WebHostJunction.com pursuant to this agreement and any exhibits or schedules hereto including, without limitation, (i) any failure to provide timely or accurately provision any WebHostJunction.com service, or (ii) adverse conditions which may result from actions by regulatory or judicial authorities.

WebHostJunction.com's entire liability for any claim or loss, damage or expense from any cause whatsoever, except for those arising from or in connection with WebHostJunction.com's gross negligence, shall in no event exceed the monies actually paid to WebHostJunction.com under this agreement by the party claiming fault. No action or proceeding against WebHostJunction.com may be commenced more than one year after the services are rendered.

This site and its content is protected by copyright as a collective work and/or compilation, pursuant to Canadian copyright laws, international conventions, and other copyright laws. Any reproduction, modification, publication, transmission, transfer, sale, distribution, performance, display or exploitation of any of the content from this site, whether in whole or in part, without the express written permission of WebHostJunction.com is strictly prohibited.

Any disputes that may arise under this Terms Of Service Agreement shall be resolved in accordance with the laws of the Province of Ontario. Each party agrees that jurisdiction and venue for any and all disputes under this Terms Of Service Agreement will be proper in the Cumberland District of the Province of Ontario, Canada, and that the establishment of such jurisdiction and venue shall be determined by WebHostJunction.com.
